This website contains information regarding a proposed class action settlement that has been preliminarily approved by the Court in Hankinson, et al. v. RTG Furniture Corp., dba Rooms To Go, Case No. 9:15-CV-81139-COHN/SELTZER.

NATURE OF THE SETTLEMENT

A proposed class action Settlement has been reached in this lawsuit, which is about ForceField® Protection Plans sold by Rooms To Go (“RTG”) to some customers who purchased leather or fabric upholstered furniture from an RTG store or online. In this case the plaintiffs allege that RTG did not professionally apply ForceField® stain protector to furniture they purchased from RTG and that RTG engaged in other actionable conduct in the sale and fulfillment of ForceField Protection Plans. RTG denies all allegations in the lawsuit, and the Court has not ruled for either side. Instead, the parties have agreed to settle the lawsuit to avoid the expense, disruption and delay of further litigation.

If you received an email or postcard notice addressed to you regarding a proposed Settlement in the lawsuit listed above, then RTG’s records show that you purchased one or more ForceField Protection Plans from RTG during the period relevant to this lawsuit and that you are a member of the class whose rights and opportunities may be affected by this lawsuit.

THE SETTLEMENT CLASS

All Persons who purchased one or more ForceField Fabric or Leather Protection Plans from RTG (including affiliates) in stores or online in the United States during the Class Period (defined in Item FAQ 8), excluding any ForceField Fabric or Leather Protection Plans that sold for $8.00 or less.

The Settlement Class does not include any judge to whom this case is assigned, any member of the judge’s immediate family, or the judge’s staff or their immediate families.
