If you registered with PositiveSingles.com or any other website indicating that it was “Powered by PositiveSingles.com,” you could get a payment from a class action settlement.

A settlement has been reached in class action lawsuits about whether Successfulmatch.com ("SM.com") used false and misleading information on its websites to attract members and displayed profiles and photographs of PositiveSingles.com ("PS.com") members without their permission.

You are included in the Settlement if you fit one of the following definitions below:

  • all persons who registered for use of the PositiveSingles.com website or any other website indicating that it was "Powered by PositiveSingles.com" during the period beginning on October 13, 2007 and ending on February 20, 2015 (the "Non-California Class").
  • all residents of the State of California who registered for use of the PositiveSingles.com website or any other website indicating that it was "Powered by PositiveSingles.com" during the period beginning on October 13, 2007 and ending on March 15, 2013 (the "California Class").

If you fit within the definition of the California Class, you are not part of the Non-California Class.

This website describes the Settlement, the lawsuits and your rights and options. If you are a member of the Non-California Class, to file a claim, you must act by September 22, 2015. To ask to be excluded from the Settlement, you must act by September 22, 2015. To object, you must act by September 22, 2015.

YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT
FILE A CLAIM This is the only way for members of the Non-California Class to get a payment from the Settlement. If you submit a Claim Form, you are choosing to stay in the Class and give up your right to sue SM.com in the future for the claims being resolved by this Settlement. Members of the California Class do not need to file a Claim Form.
EXCLUDE YOURSELF If you ask to be excluded, you will not receive a payment from this Settlement. But, you will keep the right to sue SM.com on your own in a separate lawsuit. If you do not exclude yourself, you are choosing to stay in the Class and you will be bound by the Settlement; any claims you have against SM.com relating to the claims made in the lawsuit and resolved by this Settlement will be released; and you will be forever barred from bringing them, regardless of whether you submit a claim or get a payment.
OBJECT Write to the Court with any reasons why you do not agree with the Settlement following the requirements set forth in FAQ 20.
GO TO THE FAIRNESS HEARING Ask to speak in Court about the fairness of the Settlement at the Fairness Hearing by following the requirements in FAQ 24. You may enter an appearance through counsel, at your own expense, but it is not required.
DO NOTHING California Class: If you do nothing, a payment will be mailed to your last known address and any claims you have against SM.com related to the claims made in the lawsuit and resolved by the Settlement will be released. To update your address click here.

Non-California Class: If you do nothing, you will not receive a payment from this Settlement, but any claims you have against SM.com relating to the claims made in the lawsuit and resolved by the Settlement will be released.
